Yesterday, Monday, at the Royal Palace in Casablanca, King Mohammed VI chaired a working session devoted to the subject of reviewing the Family Code.
This session comes after the body charged with reviewing the Family Code, after completing its duties within the specified period, submitted to His Majesty the King a report containing more than a hundred proposals for amendment, and after His Majesty the King, Commander of the Faithful, kindly referred those related to religious texts to the consideration of the Supreme Scientific Council. , on which he issued a legal opinion, and also after His Majesty, may God bless him, carried out the necessary arbitrations regarding the cases in which the Commission proposed more than one opinion, Or those that required review in the light of the Sharia opinion, and in which His Majesty preferred the options that are consistent with the terms of reference and objectives specified in the content of the Royal Message addressed to the Prime Minister, as well as those falling within the scope of controls specific to the work of the Commission, the most important of which is the “non-prohibition of halal” officer. “No analysis is forbidden,” according to the Royal Court’s statement.
The same communication added, “During this session, Mr. Minister of Justice Abdel Latif Wehbe, in his capacity as a member of the body charged with reviewing the Family Code, gave, in the hands of His Majesty the King, a presentation on the method and methodology of the body’s work, especially those related to the listening and hearing sessions that it organized, and the most important proposals that it It emerged from it, which it included in its aforementioned report, in addition to its desired goals.
The Minister of Endowments and Islamic Affairs, Ahmed Al-Tawfiq, in his capacity as a member of the Supreme Scientific Council, also presented the conclusions of the Council’s Sharia opinion, which provided the necessary legal framework for some of the Commission’s proposals, and opened the “door of interest” to finding solutions that are compatible with Sharia, for other proposals.
This constituted an opportunity to highlight the ability of constructive diligence to derive legal rulings, and the moderation and moderation of the Moroccan jurisprudential school, which derives its foundations from the religious constants of the Kingdom.
In this context, His Majesty the King, Commander of the Faithful, called on the Supreme Scientific Council to continue thinking and adopting constructive diligence on the issue of the family, by creating an appropriate framework within its structure, to deepen research into the jurisprudential problems posed by the developments surrounding the Moroccan family, and the innovative answers they require that keep pace with the requirements. To clarify the main contents of the review of the Family Code, His Majesty, during this session, assigned the Prime Minister and the Ministers to communicate with public opinion and inform it of the developments of this review, which the government will ensure, within reasonable time, to properly formulate and formulate it into a legislative initiative, in accordance with the provisions. relevant constitutional.
Regarding the legislative initiative to review the Family Code, and the discussion and vote that will follow in the two Houses of Parliament, His Majesty, may God protect him, mentioned the references and foundations that will frame it, which are contained in the aforementioned Royal Message, and the matter relates to the principles of justice, equality, solidarity and harmony, stemming from our true Islamic religion, as well as the values. Universality emanating from international agreements ratified by Morocco.
His Majesty the King also stressed the need to invoke the will of reform and openness to development that His Majesty seeks, by launching this promising reform initiative, twenty years after the implementation of the Family Code, and ensuring the legal, social and economic protection of the family, and looking at the contents of the review in its integrity, and that it does not It supports one group over another, but rather concerns the Moroccan family, which constitutes “the basic cell of society.”, This requires care to crystallize all of the above, in clear and understandable legal rules, to overcome conflicting judicial readings and cases of conflicting interpretations.
